Terms & Conditions

1.  Promotion Details:  Customers of Webjet Marketing North America (“Webjet”) who meet the below eligibility requirements (“Customer(s)”, “you”, “your”) may receive up to ninety nine ($99.00 USD) dollars for each reservation he/she purchases, dependent on the number of travelers included in the reservation, where such reservation has a minimum of four (4) travelers (the “Promotion”).  Such payment will be made by Webjet via check.

2.  Eligibility and General Rules: The Promotion is only open to Customers of Webjet who are legal residents of the U.S. and Canada, who are eighteen (18) years of age or older, and who have purchased a single reservation for four (4) or more travelers on www.webjet.com. This Promotion is effective as of  Apr 23, 2012, and no reservations made prior to this date shall be included in the Promotion. 

Only reservations that are successfully ticketed will be included in this Promotion.  If you cancel your reservation within fourteen (14) days of the date it was ticketed, you are not eligible for the Promotion.  All checks sent by Webjet and associated with this Promotion must be deposited by you within ninety (90) days of the date indicated on the check, which will be the date Webjet mails the check to you.  All checks not deposited within ninety (90) days  of the date indicated on the check, immediately become void.  Webjet will not reissue, replace or reimburse Customer for void checks.

3.  How to Participate:  Once an eligible Customer’s reservation is successfully ticketed, Customer is required to download the Cashback Form from http://www.webjet.com/sale/four-or-more, in PDF format, and must complete and return to Webjet via e-mail, fax, or regular mail, within fourteen (14) days of Customer Booking Date.  Webjet shall not be liable or responsible for any postage or costs associated with returning the form, as required.  Once received and processed, Webjet will mail a check for the Total Cashback Payment to the address indicated on the Customer’s Cashback Form; however, in no event will Webjet mail any checks within fourteen (14) days of the date your reservation was successfully ticketed.  

4.  General Rules: Participation in this Promotion constitutes your full and unconditional agreement to, and acceptance of, these Official Rules & Regulations (“Official Rules”).   Webjet is not responsible for (i) late, lost, delayed, damaged, postage-due, incomplete, illegible, misdirected or undeliverable Cashback Forms, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of the Cashback Form; or (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.

Webjet reserves the right, in its sole discretion, to cancel, modify, or suspend the Promotion, in whole or in part, with or without cause.  Webjet reserves the right to disqualify any Customer, as determined by Webjet, in its sole discretion. The Promotion is subject to these Official Rules.  By participating in this Promotion, you acknowledge that you have read these Official Rules and agree to abide by them and by the decisions of Webjet, which are final and binding on all matters pertaining to the Promotion. These Official Rules are governed by the law of the State of Florida, excluding rules governing choice of laws.

5. Additional Conditions: By entering the Promotion, you further agree to release, indemnify, defend and hold harmless Webjet and its parent, affiliates, subsidiaries, directors, officers, employees, agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Promotion, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Promotion or acceptance or use of the Promotion or parts thereof, including, without limitation, (i) any condition caused by events beyond Webjet’s control that may cause the Promotion to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the Promotion, or acceptance, possession, or use of the Promotion, or from participation in the Promotion; and (iii) any printing or typographical errors in any materials associated with the Promotion.

IN NO EVENT WILL WEBJET BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT WEBJET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.

EXCEPT AS OTHERWISE PROVIDED IN THESE OFFICIAL RULES, THE PROMOTION AND ALL PRIZES/AWARDS ARE PROVIDED “AS-IS”. WEBJET EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, WHETHER ARISING BY STATUTE, LAW, COURSE OF DEALING, CUSTOM AND PRACTICE, OR TRADE AND USAGE.
